Suzanne Morphew's married lover will take the stand at Barry's trial

Suzanne Morphew’s married lover Jeff Libler will be forced to take the stand when her husband Barry goes on trial for her murder in May.

Newly released court documents show Libler is included prominently on the witness list – which also includes Morphew’s girlfriend Shoshona Darke, 51.

Morphew, 53, was charged with his wife’s murder in May – a year after she vanished.Suzanne, 49, was reported missing when daughters Mallory and Macy were unable to get hold of her on Mother’s Day 2020.

The papers were released as Morphew appeared in court in Salida for a new hearing on Tuesday during which Judge Patrick Murphy was to rule on a defense motion asking for the case to be dismissed based on lack of evidence.

It has now been rescheduled after only three of the six witnesses called by the defense were heard, with Judge Murphy telling Morphew’s team to streamline and refile their motions.

The defense also used the hearing to object to the presence of a game camera trap set up by Chaffee County Sheriff close to the dad-of-two’s home.

Wearing a gray shirt and jeans and flanked by his two daughters, Morphew refused to speak to reporters as he made his way inside accompanied by his legal team.

During a previous hearing in September, cops revealed that Suzanne had enjoyed a two-year fling with dad-of-six Libler that began after the former schoolfriends reconnected on social media.

The passionate affair included overnight trips to Florida and New Orleans, while mom-of-two Suzanne regularly sent the married dad racy photos – including her final photo which showed her posing in a bikini top the day before she was reported missing.

Meanwhile Morphew, cops said, regularly logged into extramarital dating site Ashley Madison and had an account on porn website Celebrity Jihad.

Prosecutors say that while Morphew was desperate to save his marriage, Suzanne was equally determined to leave – a motive, they claim, for murder.

Morphew is due to go on trial in May and is charged with one count of murder in the first degree plus further counts of tampering with a dead body, voter fraud and attempt to influence a public figure.

He has vigorously denied murder and is currently suing the Chaffee County sheriff and prosecutor for alleged misconduct.

Morphew, who is out of jail on a $500,000 cash bond, is currently living in a house just meters from the $1.3m home he shared with Suzanne.

Since being released from jail, he has spent much of his time with Darke – and was pictured exclusively by DailyMail.com with the mom-of-one in October.

At the time, prosecutors were demanding Morphew leave the property where he has been staying since he was set free in September – and move into Darke’s modest downtown Salida home where they say he is paying the $2,000-a-month rent.

The two-bedroom home is also closer to the Chaffee County Courthouse and allows for easier GPS tracking according to the prosecution motion.

That motion was later denied, leaving Morphew to continue living at the luxury two-story Airbnb, which sits in a remote wooded area and comes complete with a glass-fronted balcony and manicured grounds that overlook his former home.

Other witnesses on the list include Jeanne Ritter, 73, who reported Suzanne missing and Morgan Gentile, a former employee of Morphew’s who told cops he had left a hotel in Broomfield, Colorado, reeking of chlorine on the day his wife vanished – first reported by DailyMail.com in September 2020.

Also on the witness list is CBI agent Jonathan Grusing who told court in September that he believed Morphew murdered his wife using animal tranquilizer before covering his tracks and disposing of her body – possibly in the remote Garfield Mine.

Law enforcement also pointed to Morphew’s phone being placed in airplane mode repeatedly over the weekend of May 9 and 10 and cited data from his truck which showed he had repeatedly opened and closed the doors in the early hours of May 10.

Meanwhile, the papers also lay bare the extent of Morphew’s relationship with housekeeper Darke which began in late 2020.

According to the arrest affidavit, cops were first tipped off about his new squeeze in December 2020 but were unable to catch them together so mounted a camera on a telegraph pole outside her home.

In early February, DailyMail.com witnessed Morphew visit the property on consecutive nights – staying until the following morning – but was unable to verify the identity of the occupant or their relationship with Morphew.

Police were later able to obtain security footage from Antler’s Hotel in Colorado Springs taken on Valentine’s Day which showed the pair checking in together.

Darke has refused to speak about her relationship with Morphew, despite being repeatedly approached by DailyMail.com, and maintained a low profile during his stay in jail.

She also denied being in a relationship with him when confronted by the cops but later admitted to meeting him in October 2020.

But since his release, she has been a constant presence in his life and, on September 28, was arrested after being caught trespassing at the former Morphew home.

Darke is understood to have been staying with Morphew at the AirBNB and was caught on security camera walking up the drive and picking up a package that had just been left by a Fedex van on the front porch of the home.

Darke was charged with one count of third-degree criminal trespass and was released from the Chaffee County Jail on a $500 bond, after telling cops her sole income is a $1,800-a-month veteran’s disability allowance.

She is currently facing legal proceedings over the trespassing charge with another hearing on the case scheduled for next week.
